Privacy policy of ING

By entering the ING Internet site ( www.ing.be), the Internet surfer declares that he has read the following information and authorises the SA/NV ING Belgium (hereafter referred to as « ING ») to process the personal data he communicates to it in accordance with the following provisions.

ING respects the privacy of the Internet surfer and of any other natural person concerned in accordance with the current legislation.

ING Belgium SA/NV whose registered office is established at 24 avenue Marnix, 1000 Brussels, Belgium (e-mail: info@ing.be) is the controller of the personal data.

The personal data which are communicated by Internet surfer to ING through the channel of ING Internet site ( www.ing.be) and/or in connection with its services, is processed by ING for the following purposes : processing of your requests (in relation to accounts, payment transactions, loans, investments, brokerage (a.o. insurance), publicity objects and/or information about banking or insurance services), customers’ relationship management, marketing of banking and insurance services, global overview of the customer, control of transactions and prevention of irregularities.

They are not intended to be communicated to any third parties other than persons designated by the Internet surfer, companies whose intervention is required to accomplish one of the above purposes or companies of the ING Belgium Group.

The Internet surfer gives his/her consent to the exchange of data which relates to him/her between the companies - existing or to be created - of the ING banking and insurance group in Belgium.

The ING Group in Belgium is a group of companies active in the fields of banking, insurance, leasing, portfolio management and/or activities in the extension of these.

This exchange of data is intended to allow the companies participating in it to obtain a global overview of customers, to carry out studies, statistics or marketing campaigns, to offer and/or provide the services mentioned above, and to control the regularity of transactions (including the prevention of irregularities).

The updated list of the companies of the ING Group in Belgium which participate in the exchange of data is available on ING Internet site and can be obtained on simple request addressed to ING.

These companies have undertaken to guarantee a high level protection of the data exchanged and are bound, as far as they are concerned, to confidentiality.

Personal data revealing racial or ethnic origin are never processed, with the sole reservation of the case where it is revealed by the data which identifies the natural person concerned (mainly the surname, first name, address and nationality). Consequently, the natural person concerned authorises the processing of these data, in accordance with article 6 of the law of 8 December 1992 on privacy protection. The categories of persons with access to these data are members of staff of ING and of the other companies of the ING Group in Belgium who are responsible to achieve one or more of the objectives mentioned above and, if need be, the persons designated by the natural personal concerned and/or the members of staff of other companies whose intervention is necessary to achieve one or more of the objectives mentioned above.

Similarly, neither personal data revealing political opinions, religious or philosophical beliefs or trade-union membership, nor data concerning sex life will be processed with the sole reservation of the case where it is revealed on the occasion of payment operations (for instance a payment instruction to make contributions to a political party). Consequently, the natural person concerned authorises the processing of such information for the purpose of executing payment transactions, in accordance with article 6 of the law of 8 December 1992 relating to the protection of privacy. The categories of persons with access to these data are the persons designated by the natural personal concerned, the ING's members of staff who are responsible to process payment operations and, if need be, the members of staff (who are responsible of a similar processing) of other companies whose intervention is necessary to process payment operations.

Any natural person may access the data which relate to him/her processed by ING or another company of the ING Group in Belgium, and, where appropriate, request rectification of any erroneous data or deletion of data processed illegally.

He/she may, at any moment, object, by means of a simple request and free of charge, to the processing of data which relate to him/her for the purpose of commercial canvassing ("marketing direct") and/or withdraw his/her consent to the exchange of data which relate to him/her within the ING Group in Belgium for the purpose of commercial canvassing ("marketing direct"); this will be taken into account as quickly as possible.

No legal provision requires an answer of the Internet surfer to the questions asked by ING or another company of the ING Group Belgium, however the fact of not answering may result, according to the case, in the impossibility for or refusal by ING or another company of the ING Group in Belgium to enter into a (pre-) contractual relationship, to continue such a relationship or to perform a transaction requested by the Internet surfer or by a third party in favour of the Internet surfer.

The personal data communicated by the Internet surfers are processed by ING in the utmost confidentiality. Nevertheless, as Internet does not provide absolute security, the respect of privacy can only be guaranteed if the personal data are transmitted through the communication channels which ING formally indicates as being protected.

Cookies

Warning files or « cookies » are used in some places of ING Internet site, in order to enhance the service provided to Internet surfers. A « cookie » is a file with information on the behaviour of a person who visits a Internetsite. It is created by the server of the Internetsite but is stored on the hard disk of the Internet surfer's computer. The next time the Internetsite is visited, the server of the Internet site can retrieve the contents of the « cookie ».

« Cookies » generated from by ING Internet site enable offers of services to be personalised according to the areas of interest of each Internet surfer by identifying them through these « cookies » .

Some « cookies » generated by ING Internet site contain data relating to the currency or the language selected by the Internet surfer, to avoid him from needing to input such data again the next time he visits the Internet site.

The other « cookies » generated by ING Internet site record data relating to the pages of ING Internet site visited by the Internet surfer and their aim is to carry out information sessions, particularly by recording the information that the Internet surfer provides in successive forms, in order to avoid the Internet surfer receiving the same advertisements or other announcements repeatedly.

These data of the Internet surfer recorded by the « cookies » are also processed by ING to carrying up statistics concerning the ING Internet site and to improve the contents of the ING Internet site.

Such « cookies » are stored on the Internet surfer's computer for a maximum period of 12 months.

Most Internet navigators are automatically configured to accept « cookies » . Nevertheless, the Internet surfer can configure his Internet navigator to inform him of each « cookie » sent or to prevent them being saved on his hard drive. However, ING cannot guarantee the Internet surfer access to Home’Bank On line services in the event of him refusing to save cookies.

Environment variables

When a Internet surfer visits ING Internet site, the following personal data, called "environment variables," are transmitted to and recorded by ING via the Internet surfer's navigation program:

- the TCP/IP address (identification number of the Internet surfer's computer on Internet),

- the brands and versions of his/her navigation software and operating systems,

- the language used by the Internet surfer,

- all the information relating to the pages of the ING Internet site visited by Internet surfer and those of other web sites through which the Internet surfer accessed ING Internet site.

The latter data are processed by ING with a view to being able to take account of the elements specific to the configuration of the Internet surfer's computer so that ING can send him the web pages requested in a adapted format, with a view to carrying out statistics concerning ING Internet site and with a view to improving the contents of its Internet site.
